1. Introduction

These Terms of Use govern your use of LinkFliQ and represent your agreement with FliqMedia Tech Private Limited (“we”, “our”, “us”).

LinkFliQ is a web-based platform that enables creators, brands, and agencies to automate Instagram Direct Messages (DMs), manage replies, and send campaign messages using Meta’s official APIs.

2. Definitions

For clarity in these Terms:

• “LinkFliQ” – refers to our platform and related services, including all automation, messaging, and campaign management tools.

• “User” – any individual or organization using LinkFliQ.

• “Creator” – a user automating Instagram communication to engage followers or fans.

• “Brand” – a business or organization using LinkFliQ to engage customers or followers.

• “Agency” – an entity managing multiple creator or brand accounts on LinkFliQ.

• “Automation” – automated DM replies, message sending, and outreach workflows performed through Meta’s official APIs.

• “Content” – any data, media, or materials uploaded, transmitted, or managed through LinkFliQ.

• “Subscription” – any paid access plan that allows ongoing use of the platform and its features.

3. Updates to These Terms

We may modify these Terms for legal, business, or operational reasons.
Significant updates will be communicated via email or platform notification.
By continuing to use LinkFliQ after updates, you agree to the revised Terms.

4. Eligibility and Registration

To use LinkFliQ, you must:

• Be at least 18 years old (or the legal age of majority in your country).

• Provide accurate information during registration.

• Maintain the confidentiality of your account credentials.

• Use your real or business identity—impersonation is strictly prohibited.

You are fully responsible for all actions taken under your account.

5. Service Overview

LinkFliQ allows users to:

• Connect their Instagram accounts securely via official Meta APIs.

• Automate DM replies, keyword triggers, and campaign messages.

• Track message counts, engagement, and performance data.

Important:

• LinkFliQ does not perform any action that violates Meta or Instagram policies.

• We do not guarantee specific engagement, revenue, or follower growth.

• You are responsible for how you use the automation features and must comply with all applicable marketing, anti-spam, and privacy laws.

6. Data Ownership and Usage

• You retain ownership of all data and content linked to your account.

• We store and process your data solely to provide automation services.

• We may anonymize and aggregate data to improve platform performance.

• We do not sell user data to advertisers or third parties.

• You may request data deletion in accordance with our Privacy Policy.

7. Payments and Subscriptions

• LinkFliQ offers both free and paid subscription plans.

• Paid plans are billed monthly or annually, as selected by the user.

• Payments are processed securely via third-party payment gateways.

• Subscriptions automatically renew unless cancelled before the next billing cycle.

• Fees are non-refundable except where required by law.

• We reserve the right to modify pricing or features with reasonable notice.

8. Acceptable Use Policy

Users are prohibited from:

• Sending unsolicited or spam messages.

• Violating Instagram’s Terms of Service or Meta’s Platform Policy.

• Misusing automation to deceive, harass, or impersonate others.

• Attempting to hack, reverse-engineer, or exploit LinkFliQ.

• Using bots or unauthorized tools to interfere with service performance.

Violations may result in immediate suspension or permanent termination.

9. Third-Party Integrations

• LinkFliQ connects only through Meta-approved APIs.

• Users must comply with Instagram’s and Meta’s respective terms of service.

• API limitations, outages, or policy changes by Meta may affect LinkFliQ’s functionality, for which we are not liable.

• LinkFliQ is an independent product and is not affiliated with or endorsed by Meta Platforms, Inc.

10. Limitation of Liability

To the fullest extent permitted by law, FliqMedia Tech Pvt. Ltd. shall not be liable for:

• Indirect, incidental, or consequential damages.

• Loss of data, revenue, or business opportunities.

• API downtime, restrictions, or third-party service errors.

• Misuse or unauthorized access by users.

Our total liability shall not exceed the total fees paid by you in the preceding three (3) months.

11. Termination of Account

We may suspend or terminate your account without prior notice if you:

• Violate these Terms or applicable laws.

• Engage in fraudulent or prohibited activity.

• Fail to make timely subscription payments.

You may cancel your subscription or delete your account anytime.
Upon deletion, your data will be removed as per our Privacy Policy.

12. Intellectual Property

All trademarks, branding, and content on LinkFliQ are owned by FliqMedia Tech Pvt. Ltd. or its licensors.
You may not copy, distribute, or modify any part of the platform without written consent.

You retain ownership of your own content, but grant us a limited license to use it solely for delivering the service.

13. Publicity Rights

By using LinkFliQ, you grant FliqMedia Tech Pvt. Ltd. permission to use your name, logo, or public social profile (e.g., handle, follower count) for case studies or promotional materials.

14. Dispute Resolution

All disputes arising under these Terms shall be resolved by binding arbitration under Indian law.
