BY USING LINKFLIQ, YOU AGREE TO THESE TERMS. PLEASE READ CAREFULLY.

1. Introduction

These Terms of Use (“Terms”) govern your access to and use of LinkFliQ, a product owned and operated by FliqMedia Tech Private Limited, a company incorporated under the laws of India (“Company”, “we”, “our”, “us”).

LinkFliQ is an AI-powered Instagram automation platform that helps brands, creators, and agencies manage comments and direct messages (DMs), handle customer queries and complaints, identify high-intent buyers and collaboration requests, and automate replies using a brand-specific knowledge base — all via Meta’s official APIs.

2. Definitions

• “LinkFliQ” – The software platform, website, dashboard, APIs, and services provided by FliqMedia Tech Pvt. Ltd.

• “User” – Any individual or organization accessing or using LinkFliQ.

• “Brand” – A business using LinkFliQ to manage Instagram conversations and automation.

• “Agency” – An organization managing one or more client Instagram accounts using LinkFliQ.

• “Automation” – AI-driven actions including auto-replies, DM handling, sentiment detection, tagging, escalation, and follow-ups executed via Meta-approved APIs.

• “Knowledge Base” – Brand-provided content such as websites, FAQs, documents, or manual inputs used to train AI responses.

• “Content” – Messages, comments, DMs, media, metadata, and analytics processed through LinkFliQ.

• “Subscription” – A paid plan that provides access to LinkFliQ features for a defined period.

3. Request-Based Access & Updates to Terms

Access Approval

• Account creation does not guarantee access to all features.

• Certain features (including Instagram connection and automation) are enabled only after approval.

• We reserve the right to approve, restrict, or revoke access at our discretion to protect platform quality and compliance.

Updates

We may update these Terms for legal, operational, or policy reasons. Continued use of LinkFliQ after changes constitutes acceptance of the revised Terms.

4. Eligibility and Registration

To use LinkFliQ, you must:

• Be at least 18 years old

• Provide accurate and complete information

• Use a valid personal or authorized business identity

• Maintain confidentiality of login credentials

You are responsible for all activity under your account.

5. Service Overview & Limitations

LinkFliQ allows users to:

• Connect Instagram accounts via official Meta APIs

• Read and classify comments and DMs using AI

• Auto-reply to comments and DMs using the brand’s knowledge base

• Handle queries and complaints via private DMs

• Detect negative sentiment and escalate issues

• Identify high-intent buyers and collaboration requests

• Apply global automation rules and post-specific overrides

• Pause, review, or override AI replies at any time

• View analytics and conversation insights

Important Disclaimers

• Automation is off by default

• LinkFliQ does not guarantee sales, conversions, or engagement

• AI responses depend on the accuracy of the provided knowledge base

• Users are fully responsible for how automation is configured and used

• LinkFliQ does not replace human judgment

6. Meta Platform Dependency

• LinkFliQ operates exclusively via Meta-approved APIs

• Instagram policies, API limits, outages, or changes may impact functionality

• We are not affiliated with Meta Platforms, Inc.

• We are not responsible for service disruption caused by Meta

All messaging is subject to:

• Instagram’s 24-hour response window

• Human Agent Tag and platform rules

7. Data Ownership & Privacy

• You retain ownership of all data and content

• We process data solely to provide LinkFliQ services

• We do not sell user data to third parties

• Aggregated, anonymized data may be used to improve the product

• Data deletion requests are handled per our Privacy Policy

8. Payments & Subscriptions

• LinkFliQ offers free trials and paid subscriptions

• Paid plans renew monthly or annually unless cancelled

• Fees are non-refundable unless required by law

• Pricing and features may change with notice

9. Acceptable Use Policy

Users must NOT:

• Send spam or unsolicited messages

• Bypass Meta’s 24-hour messaging rules

• Abuse automation or follow-ups

• Harass, impersonate, or mislead users

• Misuse AI to create deceptive or harmful experiences

• Reverse-engineer or disrupt the platform

Violations may result in suspension or termination.

10. Limitation of Liability

To the maximum extent permitted by law, FliqMedia Tech Pvt. Ltd. is not liable for:

• Loss of revenue, data, or business

• Customer disputes arising from automated replies

• AI misinterpretation or incorrect responses

• Meta API downtime or policy restrictions

Total liability shall not exceed the fees paid by you in the last 3 months.

11. Account Suspension & Termination

We may suspend or terminate access if you:

• Violate these Terms or Meta policies

• Misuse automation

• Engage in fraud or abuse

• Fail to pay subscription fees

You may cancel anytime. Data handling follows our Privacy Policy.

12. Intellectual Property

• All platform code, UI, branding, and trademarks belong to FliqMedia Tech Pvt. Ltd.

• Users may not copy or redistribute platform materials without written consent

• You retain ownership of your content; we use it only to deliver services

13. Publicity & Case Studies

By default, you grant permission for us to use:

• Brand name

• Logo

• Public Instagram handle

• High-level case study insights

You may opt out anytime by emailing support@linkfliq.com.

14. Dispute Resolution

All disputes shall be resolved through binding arbitration under Indian law.

15. General Terms

• These Terms override all prior agreements

• Rights are non-transferable without consent

• We may assign rights in case of merger or acquisition

• If any clause is unenforceable, remaining clauses remain valid
