BY ACCESSING OR USING LINKFLIQ, YOU AGREE TO THESE TERMS. PLEASE READ THEM CAREFULLY.

1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of LinkFliQ, a product owned and operated by FliqMedia Tech Private Limited, incorporated under the laws of India (“Company”, “we”, “our”, or “us”).

LinkFliQ is an AI-powered Instagram automation platform designed for brands, e-commerce stores, and agencies. It helps businesses manage Instagram comments and direct messages (DMs), resolve customer queries using Shopify data, automate routine conversations, identify buying intent, and escalate sensitive issues to human agents using Meta’s official APIs.

2. Definitions

“LinkFliQ” – The website, dashboard, software platform, APIs, and related services provided by FliqMedia Tech Pvt. Ltd.

“User” – Any individual, business, or organization accessing or using LinkFliQ.

“Brand” – A business using LinkFliQ to manage Instagram conversations.

“Agency” – An organization managing one or more client accounts using LinkFliQ.

“Automation” – AI-driven actions including message classification, automated replies, intent detection, tagging, routing, and escalation.

“Human Escalation” – Routing of sensitive or complex conversations to a human representative.

“Knowledge Base” – Brand-provided data including FAQs, website content, policies, documents, or manual inputs used to generate responses.

“Shopify Integration” – Access to store data such as products, pricing, inventory, and order information used for contextual responses.

“Content” – Comments, messages, media, metadata, analytics, and other data processed through the platform.

“Subscription” – A paid plan granting access to LinkFliQ features.

3. Access & Updates to Terms

Access Approval

Creating an account does not automatically guarantee access to all features.

Certain functionality — including Instagram automation, Shopify integration, or advanced AI features — may require approval or activation.

We reserve the right to approve, limit, suspend, or revoke access to protect platform integrity and compliance.

Updates to Terms

We may update these Terms from time to time for legal, operational, or product-related reasons. Continued use of LinkFliQ after changes constitutes acceptance of the updated Terms.

4. Eligibility & Account Registration

To use LinkFliQ, you must:

  • Be at least 18 years old

  • Provide accurate registration information

  • Use an authorized business or personal identity

  • Maintain confidentiality of login credentials

You are responsible for all activities occurring under your account.

5. Service Overview & Limitations

LinkFliQ enables users to:

  • Connect Instagram accounts via Meta-approved APIs

  • Connect Shopify stores for real-time product and order data

  • Automatically resolve routine customer queries

  • Auto-handle comments and DMs using AI

  • Detect buying intent and conversation patterns

  • Identify negative sentiment or risk signals

  • Escalate sensitive or high-risk conversations to humans

  • Apply automation rules and conversation routing

  • Access analytics and conversation insights

Important Clarifications

  • LinkFliQ is designed to automate routine conversations while allowing human intervention when necessary.

  • Human escalation is automatic; LinkFliQ does not provide manual AI reply editing workflows unless explicitly offered in the dashboard.

  • AI responses depend on the quality and accuracy of provided data.

Disclaimers

  • Automation may reduce workload but does not replace human judgment.

  • LinkFliQ does not guarantee sales, conversions, or engagement outcomes.

  • Users are responsible for configuring and reviewing automation behavior.

6. Platform Dependencies (Meta & Shopify)

LinkFliQ relies on third-party platforms including Meta and Shopify.

  • Instagram functionality operates exclusively via Meta-approved APIs.

  • Shopify integrations depend on Shopify API availability and permissions.

  • Changes, outages, limits, or policy updates from Meta or Shopify may affect functionality.

We are not affiliated with Meta Platforms, Inc. or Shopify Inc., and are not responsible for service interruptions caused by their systems.

All messaging remains subject to:

  • Instagram platform policies

  • Meta messaging windows and rules

  • Platform enforcement actions outside our control

7. Data Ownership & Privacy

  • You retain ownership of all brand and customer data.

  • We process data solely to deliver LinkFliQ services.

  • We do not sell customer data to third parties.

  • Aggregated and anonymized data may be used to improve product performance.

Data deletion requests are handled according to our Privacy Policy.

8. Payments, Credits & Subscriptions

LinkFliQ may offer free trials, credits-based usage, or paid subscriptions.

  • Paid plans renew unless cancelled.

  • Pricing, credit limits, and features may change with notice.

  • Fees are non-refundable unless required by law.

  • Users are responsible for maintaining valid payment methods.

Unused credits may expire according to plan terms.

9. Acceptable Use Policy

Users must NOT:

  • Send spam or unsolicited automated messages

  • Circumvent Meta platform rules or messaging limits

  • Misuse automation in deceptive or harmful ways

  • Harass, threaten, or impersonate others

  • Use AI responses for illegal activity

  • Attempt to reverse-engineer or disrupt the platform

Violations may result in suspension or termination.

10. Limitation of Liability

To the maximum extent permitted by law, FliqMedia Tech Pvt. Ltd. shall not be liable for:

  • Loss of revenue or business opportunities

  • Customer disputes arising from automated responses

  • AI misclassification or incorrect interpretation

  • Meta or Shopify API outages or policy changes

  • Data loss caused by third-party platforms

Total liability shall not exceed the total fees paid by the user during the previous three (3) months.

11. Account Suspension & Termination

We may suspend or terminate accounts if you:

  • Violate these Terms or third-party policies

  • Misuse automation systems

  • Engage in fraud or abusive behavior

  • Fail to pay applicable fees

Users may cancel at any time. Data handling follows our Privacy Policy.

12. Intellectual Property

All platform software, design, branding, and technology belong to FliqMedia Tech Pvt. Ltd.

Users may not copy, distribute, or reproduce platform components without written consent.

Users retain ownership of their data and brand content; we use it solely to provide services.

13. Publicity & Case Studies

Unless explicitly opted out, you grant permission for us to use:

  • Brand name

  • Logo

  • Public Instagram handle

  • High-level performance or case study insights

14. Dispute Resolution

All disputes shall be resolved through binding arbitration under Indian law.

  • Governing Law: Arbitration and Conciliation Act, 1996

  • Seat of Arbitration: Chandigarh, India

  • Language: English

15. General Terms

  • These Terms override previous agreements related to LinkFliQ.

  • Rights are non-transferable without consent.

  • We may assign rights in case of merger or acquisition.

  • If any provision is found invalid, remaining provisions remain enforceable.
